1. Services Provided
ZethEli Designs offers a wide range of services, including but not limited to:
- Web Development: Custom websites, e-commerce solutions, and web-based applications.
- Social Media Marketing: Strategy development, campaign management, content creation, and social media advertising.
- Search Engine Optimization (SEO): On-page optimization, link-building strategies, content marketing, and keyword analysis to improve search rankings.
- Graphics Design: Logos, brand identity packages, promotional materials, and other design assets.
- Video Production & Editing: Creating and editing videos for marketing, social media, and corporate purposes.
- Gamer Essentials: Stream overlays, custom graphics, branding for streamers and gamers, and gaming-related web development.
2. Payments
2.1 Payment Terms:
Full payment must be made according to the agreed-upon pricing before the final delivery of the services. For services that are paid in installments, work will be halted until the outstanding payments are received.
2.2 Invoices:
Invoices are sent upon confirmation of the project, and all payments must be completed within 7 days of receipt. We reserve the right to halt services if payments are not received in full.
2.3 Late Payments:
A late payment fee of 2% per month will be applied to any overdue balances beyond 30 days from the invoice due date.
3. Post-Service Support
3.1 Support Start:
Support begins after full payment has been made. No support will be provided before the final payment is received.
3.2 Support Duration:
We offer 30 days of free support from the date of full payment. This includes bug fixes, troubleshooting, and minor adjustments within the scope of the original project agreement.
3.3 Extended Support:
After the 30-day free support period, additional support will be billed at $78/hour or according to our ongoing support plans:
- Basic Support Plan: $100/month for up to 2 hours of support.
- Premium Support Plan: $250/month for up to 5 hours of support.
- Custom Support Plan: Available upon request for larger or ongoing projects.
4. Project Scope and Changes
4.1 Scope of Services:
The scope of each project will be agreed upon in advance through a written contract or email agreement. Any work outside the original scope will be subject to additional charges.
4.2 Revisions:
Clients are entitled to 3 rounds of revisions within the original project scope. Additional revisions will be billed at an hourly rate of $78.
4.3 New Features:
Requests for new features, functionality, or design elements that go beyond the agreed project scope will be treated as new services and will incur additional costs.
5. Cancellation and Refund Policy
5.1 Project Cancellation:
Clients may cancel their project by providing written notice. Depending on the stage of work, a partial refund may be issued. If significant work has been completed, no refund will be provided.
5.2 Refund Eligibility:
Refunds are provided only for services not yet delivered. Once the service (such as a website, design, or automation setup) has been delivered, no refunds will be issued.
6. Intellectual Property
6.1 Ownership:
Upon full payment, clients will receive ownership rights to all final deliverables, including websites, logos, videos, and other design assets. ZethEli Designs retains the right to use these projects in portfolios, marketing, and promotional materials unless otherwise agreed upon.
6.2 Third-Party Software and Tools:
Certain services may involve third-party platforms (such as GHL, Zapier, Pabbly, or Active Pieces). Clients are responsible for any fees or licensing costs associated with these platforms.
7. Client Responsibilities
7.1 Content:
Clients are responsible for providing all content (text, images, etc.) required for the project in a timely manner. ZethEli Designs is not responsible for any delays caused by the client’s failure to provide necessary content.
7.2 Feedback:
Clients agree to provide timely feedback and approvals during the project to ensure it progresses as scheduled.
8. Liability
8.1 Limitation of Liability:
ZethEli Designs is not liable for any indirect, incidental, or consequential damages, including but not limited to loss of revenue, profits, or data, arising from the use of our services.
8.2 Third-Party Integrations:
We are not responsible for the performance, downtime, or security issues of any third-party platforms or services integrated as part of your project.
9. Confidentiality
We value your privacy and agree to keep any proprietary information or sensitive client data confidential. For details on how we collect and use your information, please review our Privacy Policy.
10. Governing Law
These Terms and Conditions shall be governed and construed in accordance with the laws of the State of Illinois. Any disputes arising under these terms shall be subject to the jurisdiction of the courts in Illinois.
11. Modifications to Terms
ZethEli Designs reserves the right to update these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the modified terms.
